Your attendance at our events indicates that you have read completely, understand and agree to all of the following:

1. I/we acknowledge that I/we are attending an event that may involve sensual and erotic activities, and I/we voluntarily choose to participate in and/or observe such activities.
2. I/we commit to maintaining respectful behavior at all times and fully understand that consent is paramount. I acknowledge that a clear “no” means “no.”
3. While LUSH events may include sensual and erotic activities, I/we acknowledge that there is no guarantee or obligation for any LUSH Party staff member, party guest, or attendee to engage in such activities.
4. Any individual found to be intoxicated or displaying disrespectful or irresponsible behavior will be promptly escorted from the event and may be prohibited from attending future events. LUSH Party Staff reserves the right to remove anyone from an event without providing an explanation or issuing a refund.
5. I/we understand and agree that I/we are solely responsible for any bodily injury, dismemberment, loss of personal property, or expenses resulting from my own negligent actions or the negligent actions of others during scheduled, planned, unscheduled, or unplanned activities, or due to equipment or device failures or malfunctions. I accept full responsibility for such occurrences.
6. I/we recognize that accidents and mistakes can happen. In consideration of my right to participate in sensual and erotic activities and other activities during LUSH events, I certify that I am in good physical and psychological health, without any conditions that could pose risks to myself or others.
7. As part of my participation in and/or observation of sensual and erotic activities, whether scheduled, planned, unscheduled, or unplanned, I hereby release LUSH, its associates, agents, assistants, guests, licensees, and invitees from any legal liability. I pledge not to file lawsuits, claims, or take legal action against them for any injury or death resulting from my voluntary participation in these activities.
8. This Release of Liability is legally binding and applies to me, my heirs, estate, assigns, legal guardian, and personal representatives.
9. I/we understand and agree not to capture anyone’s images or photos without their explicit permission. Any photos on the LUSH.com website are for the exclusive use of members and must not be shared or distributed without prior consent.
10. I/we have thoroughly read and comprehended this Release of Liability Waiver. I am aware that by signing this waiver, I am relinquishing legal rights that I may have otherwise held, and I am doing so voluntarily, with full awareness of the associated risks.
11. I/we confirm that I/we are at least 21 years of age.

Important Network Terms of Service:

The following Terms of Service are applicable to your use of this Network. Your conduct and the content you share on the Network must adhere to these terms. By registering, using, or browsing this Network, you acknowledge that you have read, understood, and agree to be bound by these terms.

This Network is explicitly intended for individuals aged 21 and older, unless the member application page states otherwise.

Additionally, you must not:

• Attempt to gain unauthorized access to computer systems or disrupt Network functionality.
• Use this Network for illegal distribution of copyrighted content.
• Share content that is harmful or violates the terms.
• Misuse data or employ misleading tactics.
• Impose an unreasonable load on the Network.
• Interfere with the feedback or ratings systems.
• Disrupt Network functionality through code manipulation.

To report copyright infringement on this Network, refer to the DMCA Notification Guidelines.

You agree not to encourage third parties to engage in prohibited conduct on this Network. These Network Terms of Service also apply to our service providers, who may take action to ensure compliance.

While our online service provider handles technology and hosting, the Network Creator controls content, membership, and policies. By participating on this Network, you agree to indemnify and hold harmless the service provider in matters related to your interactions with others using this Network.

12. Data Deletion

If a user wishes to delete their data, they must delete their account. When an account is deleted or if a user decides to no longer participate in our services, data deletion will be handled as follows:

• Majority data deletion will occur upon user consent.
• Complete data deletion will occur after 90 days. Please refer to the “Data Retention” section below for more details regarding the 90-day data retention period.

Users can request the deletion of their personal data at any time. If such a request is made, the account will be deactivated, and data will be retained in backups and life-cycle management to ensure that data is not stored for more than 90 days. Users may request data deletion by emailing helpdesk@lushparty.com, canceling their user account, or filling out the GDPR User Rights form on the site. If a user fails to make payment for any premium plans, Lush Party Inc. will remove all paid features and return users to the Free/Trial Plan. Please see section 7.5 of our Terms of Service for user inactivity under the Free Plan. If Lush Party Inc. deletes an account due to inactivity, the same scenarios will apply.

13. Data Retention

Information Storage and Security

Lush Party Inc. uses data hosting service providers in the United States to host collected information, and we employ technical measures to secure all data. Despite the comprehensive security measures and safeguards in place, no security system is completely immune to intrusion due to the inherent nature of the internet. How Long We Keep Information

The duration for which we retain the information we collect about you depends on the type of information, as detailed below. After this period, we will make every effort to delete your information, or if this is not feasible (for example, due to data stored in backup archives), we will securely store your information and isolate it from further use until deletion is possible.

• User Account Information: We retain user information until the user deletes their account(s), after which we continue retaining the data for up to 90 days following account deletion. This includes email, admin notes, IPs, access history, payment history, and nickname. Lush Party Inc. maintains this practice for the following reasons:
  • In case a user’s account has been compromised and intentionally deleted, Lush Party Inc. will help maintain and restore data once the situation is resolved.
  • In the event that an account was mistakenly deleted by the user, Lush Party Inc. can restore the data.
  • Various data storage systems and backups have different lifecycle policies, typically held for a maximum of 90 days.
• The Information You Share on the Services: If a user’s account is deactivated or disabled, some user information and content provided by the user will remain to allow other members or users to make full use of the services. For example, comments and content provided by the user in forums will continue to be displayed. Lush Party Inc. will retain user data for up to 90 days after account cancellation in case users decide to renew within that time frame.
• Marketing and Promotional Information: If users have elected and provided consent to receive marketing and promotional emails from Lush Party Inc., we retain information about their marketing preferences unless specifically asked to delete such information. Lush Party Inc. retains information derived from cookies and other tracking technologies for a reasonable and specific period from the date such information was created.

14. Security

At Lush Party Inc., we take the security of your data very seriously. Our security practices are transparently detailed in this Privacy Policy to ensure you have a clear understanding of how we handle security.

15. Age Limitation

Lush Party Inc. has further committed to referring any unresolved privacy complaints from EU users to an independent dispute resolution mechanism, such as the JAMS Privacy Shield Program. 20. No Guarantees for Factors Beyond Lush Party Inc.’s Control
